Reference: Parade Motor Vehicle Fatal Accident

Date of Release: Monday, December 4, 2006 1600hrs.

THIS IS A COPY OF THE PRESS CONFERENCE PRESS REELASE BY CHIEF MICHAEL J. MAGNANT.

The Portsmouth Police Accident Investigation Team continues to investigate the motor vehicle fatality that occurred on Saturday December 2, 2006, at approx 6:15PM. Thomas E. Fogarty, age nine, of Greenland NH., one of approximately 15 Greenland NH Cub Scouts who were participating in the parade. At this time we believe that Thomas somehow fell from the float and was run over by the trailerís double-axle wheels. This has not yet been confirmed. Thomas was transported to Portsmouth Regional Hospital by ambulance where he died of internal injuries.

The float was actually a trailer being pulled by a pick-up truck. The truck was driven by an adult. Both the float and truck have been impounded by the police department pending an examination by our accident reconstructionist. The name of the driver is being withheld pending the outcome of this investigation. At this time a number of witnesses have been interviewed. No charges are pending.

The accident occurred on Islington St in the vicinity of Columbia Street shortly after the parade started. We are asking that if anyone witnessed the accident, or perhaps has video or photos of the parade route at Islington and Columbia in the vicinity of The Bread Box or Dunkin Dounts, to call Lt. Rod McQuate at 610-7531 or Crimestoppers at 427-1199. Any information received may be beneficial.

The witness interviews and analysis of physical evidence may take several months to conclude. I know we would like to have answers today but these are complex investigations that take time. I would like to caution the press about speculating about the cause of the accident.

This is a terrible tragedy that has deeply affected the community. Literally our hearts are broken by Thomasís death and our thoughts and prayers are with him and his family.

No other details will be released at this time.
