New Hampshire Supreme Court Strikes Down $3.57 Million Jury Award in Boyle Case

Today the New Hampshire Supreme Court struck down and vacated the $3.57 million dollar jury awarded to James Boyle, Trustee of the 150 Greenleaf Avenue Realty Trust by a Rockingham County Superior Court in February of 2018. 

Two decisions were issued by the New Hampshire Supreme Court relative to the two pending cases involving James Boyle and the property at 150 Greenleaf Avenue. Although the New Hampshire Supreme Court failed to recognize the City’s legal interests in maintaining the sewer line that was constructed in 1967 and 1968, the overall decision creates opportunities for new settlement discussions. 

The City is disappointed that the New Hampshire Supreme Court failed to support the City’s acquisition by eminent domain. These are complicated and interrelated decisions which are being closely reviewed by the City and its counsel
