Assault on May 29th

The Portsmouth Police Department has concluded its investigation into an altercation which had been reported at 12:38 AM on May 29th on Fleet Street, and as a result the following two individuals have been arrested and charged:
Arrestee #1
- Ethan Fishbaugh age: 27, 6 Foyes Lane, Kittery, ME 03904
On the following charges:
- 4 counts of 2nd Degree Assault (All Class B Felonies)
- Falsifying Physical Evidence (Class B Felony)
- 4 counts of Simple Assault (All Class A Misdemeanors)
Arrestee #2
- Nicholas Abraham age: 27. 24 Columbia Court Apt. 4, Portsmouth, NH
On the following charges:
- Simple Assault (Class B Misdemeanor)
- Criminal Threatening (Class B Misdemeanor)
Detective Erik Widerstrom was the lead detective in this investigation and was able to conclude that an altercation occurred at 175 Fleet Street and was initiated inside of Gilley’s PM lunch. The involved participants then left the restaurant and another altercation occurred on Fleet Street. The above two individuals were involved in both altercations and as a result Ethan Fishbaugh was charged with the above charges. The 2nd Degree assault charges allege Fishbaugh knowingly and recklessly caused serious bodily injury by stabbing Abraham with a knife. The falsifying physical evidence charge is a result of Fishbaugh purposely concealing a knife to impair its availability in the course of the investigation. Three of the four simple assault charges against Fishbaugh are for purposely causing unprivileged contact to Abraham by punching him in the head. The fourth simple assault charge is for purposely causing unprivileged contact to another person by shoving them in the shoulder area.
Ethan Fishbaugh turned himself in on an arrest warrant for the above charges on June 13th and was released on $10,000.00 cash bail. Fishbaugh has a scheduled arraignment date of June 29th at 8:30 AM in Rockingham County Superior Court where this case will be presented by the Rockingham County Attorney’s Office.
Nicholas Abraham was charged with simple assault for causing unprivileged physical contact to Ethan Fishbaugh by squirting him with hot sauce. The criminal threatening charge is a result of Abraham purposely attempting to place Fishbaugh in fear of imminent physical contact by pursuing him out of Gilley’s while Fishbaugh was attempting to leave the area.
Abraham turned himself in on an arrest warrant for the above charges on June 14th and was released on $1200.00 Personal Recognizance bail. Abraham has a scheduled arraignment date of June 29th at 8:30 AM in Rockingham County Superior Court where this case will be presented by the Rockingham County Attorney’s Office.
